Placing an order on this site constitutes a declaration under oath of being of legal age. LGEMD DIGITAL reserves the right to cancel any order if there is doubt about the buyer's age.

ARTICLE 1 – SCOPE OF APPLICATION

These Terms and Conditions of Sale (hereinafter "T&Cs") govern all sales of products made by LGEMD DIGITAL (hereinafter "the Seller") through the BeastyLov website (hereinafter "the Site") to any consumer buyer (hereinafter "the Customer"), whether residing in France, the European Union, the United States, the United Kingdom, Australia, Canada, or any other authorized country.

Placing an order on the Site implies full, unconditional acceptance of these T&Cs. The applicable T&Cs are those in force at the date of the order. LGEMD DIGITAL reserves the right to modify them at any time; modifications apply only to orders placed after their publication.

ARTICLE 2 – PRODUCTS

2.1 – Nature of Products

The Site sells adult products, including fantasy sextoys and intimate accessories (hereinafter "Products"). These Products are exclusively intended for adults, for private and personal use only.

2.2 – Product Characteristics

The essential characteristics of the Products (description, materials, dimensions, photographs) are presented on each product page. The Customer must read them carefully before placing any order. Slight variations in color or appearance may exist due to screen display conditions and shall not engage LGEMD DIGITAL's liability.

2.3 – Product Availability

Offers are valid while stocks last. If a Product becomes unavailable after an order is placed, LGEMD DIGITAL will notify the Customer by email and offer either a full refund or an exchange for an equivalent Product.

2.4 – Product Safety and Compliance

LGEMD DIGITAL ensures that Products comply with applicable regulations, including:

  • EU Regulation 2023/988 on general product safety (GPSR);
  • REACH standards regarding the absence of hazardous chemical substances in body-contact materials;
  • Traceability and product recall requirements applicable to de facto importers on the European market.

ARTICLE 3 – PRODUCT USAGE PRECAUTIONS

3.1 – General Warnings

The Products sold on this Site are intimate items intended for adult, private, and personal use only. Before any use, the Customer must carefully read the instructions provided with each Product.

The Customer acknowledges and accepts the following usage precautions:

  • Use only lubricants compatible with the Product's material (water-based lubricants recommended for silicone Products);
  • Clean and disinfect the Product before and after each use in accordance with the manufacturer's instructions;
  • Never use a Product showing signs of deterioration, cracks, or visible defects;
  • Keep Products out of reach of children in a clean, dry place;
  • Do not use Products if you have a known allergy to any of the component materials;
  • Electric Products (vibrating, etc.) must not be used near water unless explicitly stated otherwise by the manufacturer;
  • Immediately stop use if pain, irritation, or allergic reaction occurs and consult a healthcare professional if necessary.

3.2 – Materials and Compatibility

The materials composing each Product are indicated on the corresponding product page. It is the Customer's responsibility to verify the absence of any personal contraindication (allergy to silicone, TPE, ABS, etc.) before purchasing and using the Product.

3.3 – Limitation of Liability Related to Use

LGEMD DIGITAL disclaims all liability for any physical, material, or other damage resulting from:

  • Failure to comply with usage precautions;
  • Use of the Product in a manner inconsistent with its intended purpose;
  • An allergy or individual reaction to component materials that the Customer failed to check for compatibility;
  • Use by a minor or unauthorized person.

ARTICLE 4 – CUSTOMER COMMITMENTS

4.1 – Declarations and Commitments at the Time of Order

By validating their order on the Site, the Customer expressly and irrevocably declares:

  • Being at least 18 years of age, or the higher legal age required by the laws of their country of residence;
  • Residing in a country where the purchase, importation, and possession of the ordered Products are legal;
  • Having read the essential characteristics of the Products, their materials, and their usage precautions;
  • Fully and unconditionally accepting these T&Cs and the Site's Privacy Policy;
  • Intending to use the Products in a strictly private, personal, and lawful context.

4.2 – Customer Responsibility

By placing an order, the Customer acknowledges being solely responsible for:

  • The accuracy of information provided during the order (age, address, country of residence);
  • Compliance with the laws and regulations applicable in their country of residence regarding the purchase, importation, and possession of Products;
  • The use made of the Products after delivery.

Any false declaration engages the Customer's exclusive liability. LGEMD DIGITAL shall not be held responsible for the consequences of inaccurate information provided by the Customer.

ARTICLE 5 – AGE AND GEOGRAPHIC RESTRICTIONS

5.1 – Age Restriction

Sales are strictly reserved for adults, meaning:

  • Minimum 18 years in France, the European Union, the United Kingdom, and Australia;
  • Minimum 21 years in US states requiring a higher legal age;
  • The applicable legal age in any other country of residence.

5.2 – Geographic Restriction

Sales are prohibited in countries where the commercialization, importation, or possession of Products is illegal. LGEMD DIGITAL reserves the right to refuse or cancel any order from an excluded country. It is the Customer's responsibility to verify the legality of the purchase in their country of residence before ordering.

ARTICLE 6 – ORDER

6.1 – Order Process

To place an order, the Customer must:

  1. Select the desired Products and add them to the cart;
  2. Review the cart contents and proceed to checkout;
  3. Enter delivery and billing information;
  4. Choose a payment method;
  5. Expressly accept these T&Cs;
  6. Confirm and pay for the order.

6.2 – Order Confirmation

Every validated and paid order triggers a confirmation email summarizing the Products ordered, total amount, delivery address, and order number. The sale is deemed concluded upon receipt of payment confirmation.

6.3 – Processing Time

Each order is processed and transmitted to the supplier within 1 to 3 business days from payment confirmation, excluding weekends and public holidays. This processing time is in addition to the delivery time.

6.4 – Delivery Address Change

The Customer may request a change to their delivery address within 24 hours of placing the order, provided it has not yet been shipped. The request must be sent to support@beastylov.com with the order number. Once the package has been dispatched, LGEMD DIGITAL no longer has control over delivery. In such cases, the Customer is advised to contact the local carrier directly upon the package arriving in their country.

Important: LGEMD DIGITAL does not offer reshipment or refunds for packages that are undeliverable due to an incorrect address provided by the Customer.

6.5 – Product Exchange

The Customer may request an exchange for a different product within 8 hours of placing the order. The request must be sent to support@beastylov.com including the order number and the desired replacement product. Beyond this window, the order may already be in preparation and the exchange can no longer be guaranteed.

6.6 – Order Cancellation

Any cancellation request must be sent to support@beastylov.com within 2 hours of order validation. After this period, the order has been transmitted to the supplier and can no longer be cancelled.

6.7 – Order Refusal

LGEMD DIGITAL reserves the right to refuse any order in case of doubt about the buyer's age, orders from excluded countries, suspected fraud, or anomalies in the information provided.

ARTICLE 7 – PRICING

7.1 – Applicable Prices

Prices are displayed in euros (€) inclusive of all applicable taxes. The applicable prices are those in force at the time of order validation.

7.2 – DDP Shipping (Delivered Duty Paid)

LGEMD DIGITAL ships all orders under DDP (Delivered Duty Paid) terms. This means:

  • All customs duties, import taxes, and administrative clearance fees are included in the displayed price and fully covered by LGEMD DIGITAL;
  • The Customer will have no additional charges to pay upon delivery or at customs, regardless of their country of residence;
  • The price shown at checkout is the final price, all charges included.

7.3 – Shipping Fees

Shipping is free on all orders, regardless of destination country and with no minimum purchase amount.

7.4 – VAT and Taxes

For customers residing in the European Union, the applicable VAT is that of the Customer's country of residence, collected via the OSS (One Stop Shop) mechanism. For customers residing outside the EU (USA, UK, Canada, Australia, etc.), applicable local taxes are included in the DDP price.

7.5 – Promotional Codes

Promotional codes offered by LGEMD DIGITAL are:

  • Valid once per Customer unless otherwise stated;
  • Not combinable with other offers unless expressly indicated;
  • Non-refundable and not exchangeable for cash;
  • Subject to a validity date indicated at the time of issue;
  • Applicable only to eligible Products specified in the offer.

LGEMD DIGITAL reserves the right to suspend or cancel any promotional program in the event of fraudulent use.

ARTICLE 8 – PAYMENT

8.1 – Accepted Payment Methods

Payment is made exclusively through the secure payment methods offered by Shopify Payments, including Visa, Mastercard, and American Express credit and debit cards.

8.2 – Payment Security

All transactions are secured by SSL protocol and processed by Shopify Payments, a PCI-DSS certified payment service provider. LGEMD DIGITAL does not store any banking data at any time.

8.3 – Discreet Billing

For confidentiality purposes, the descriptor appearing on the Customer's bank statement will be "LGEMD DIGITAL", with no mention of the nature of the Products purchased.

8.4 – Payment Failure

In the event of payment failure or rejection, the order will be automatically cancelled. LGEMD DIGITAL reserves the right to suspend any Customer account in the event of proven fraud or abusive chargebacks.

ARTICLE 9 – DELIVERY

9.1 – Delivery Zone

LGEMD DIGITAL delivers worldwide, except to countries where the sale or importation of Products is illegal.

9.2 – Delivery Times

Products are shipped from China. The timeframes below are from the date of shipment, excluding the 1 to 3 business day processing time and excluding weekends and public holidays:

Total estimated time = processing (1–3 business days) + delivery time above, excluding weekends and public holidays.

These timeframes are estimates and may be extended due to exceptional circumstances (holiday periods, customs disruptions, force majeure events).

9.3 – DDP Shipping and Discretion

All packages are shipped:

  • Under DDP terms: customs duties and import taxes fully covered by LGEMD DIGITAL, no additional charges upon delivery;
  • In neutral, discreet packaging, with no indication of the nature of the Products on the outer packaging.

9.4 – Order Tracking

A tracking number is sent to the Customer by email as soon as the package is dispatched.

9.5 – Incorrect Delivery Address

The Customer is solely responsible for the accuracy of the delivery address provided. In the event of non-delivery due to an incorrect address, LGEMD DIGITAL will not offer reshipment or a refund.

9.6 – Non-Received Package

If a package has not been received within 45 business days of the shipment confirmation, the Customer should contact LGEMD DIGITAL at support@beastylov.com. An investigation will be opened with the carrier. In the event of confirmed loss, LGEMD DIGITAL will arrange reshipment or a full refund.

ARTICLE 10 – DEFECTIVE PRODUCT

In the event of receiving a defective product, the Customer must contact LGEMD DIGITAL within 72 hours of receiving their order at support@beastylov.com, including photos or a short video clearly showing the issue.

Each case is reviewed individually and LGEMD DIGITAL will work to find the best solution, which may include:

  • Reshipment of a conforming, non-defective Product;
  • A partial or full refund depending on the nature of the defect.

Any defect claim reported beyond the 72-hour window may not be accepted, except within the scope of the legal warranties set out in Article 12.

ARTICLE 11 – RIGHT OF WITHDRAWAL AND RETURNS

11.1 – Exclusion of Right of Withdrawal for Hygiene Reasons

In accordance with Article L221-28 12° of the French Consumer Code, the right of withdrawal does not apply to Products that have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.

As the Products sold on this Site are intimate items delivered in sealed packaging, any Product whose seal has been broken after delivery is definitively excluded from the right of withdrawal and cannot be subject to any return or refund.

11.2 – Right of Withdrawal on Unsealed Product

For any Product whose sealed packaging has not been opened, the Customer has 14 calendar days from the date of receipt to exercise their right of withdrawal, without needing to provide a reason, by notifying their decision to support@beastylov.com with their order number.

The Product must be returned in its original, intact, and sealed packaging within 14 days of the notification. Return shipping costs are the Customer's responsibility.

11.3 – Strict Return Conditions

All returns are subject to the following cumulative conditions:

  • Product unused, unsealed, and in its original condition;
  • Original packaging intact;
  • Notification within the 14-day period;
  • Product shipped within 14 days of notification;
  • Order number provided.

Any return that does not meet these conditions will be refused and sent back to the Customer at their expense.

11.4 – Refund

In the event of a valid withdrawal, LGEMD DIGITAL will process the refund within 14 days of receiving the returned Product, using the same payment method used for the original order.

ARTICLE 12 – LEGAL WARRANTIES

12.1 – Legal Warranty of Conformity

In accordance with Articles L217-4 et seq. of the French Consumer Code, LGEMD DIGITAL is liable for any lack of conformity existing at the time of delivery. The legal warranty of conformity is 2 years from the date of delivery.

12.2 – Legal Warranty Against Hidden Defects

In accordance with Articles 1641 et seq. of the French Civil Code, LGEMD DIGITAL is liable for hidden defects that render the Product unfit for its intended purpose.

12.3 – US Customers — Implied Warranties

For customers residing in the United States, to the maximum extent permitted by applicable law, all implied warranties, including warranties of merchantability and fitness for a particular purpose, are disclaimed. LGEMD DIGITAL's liability shall not exceed the purchase price of the Product.

ARTICLE 13 – PERSONAL DATA AND CONFIDENTIALITY

LGEMD DIGITAL commits to not disclosing to any third party the personal information provided by the Customer when placing an order. This information is strictly confidential and will only be used by LGEMD DIGITAL's internal departments for the following purposes:

  • Order processing and tracking;
  • Customer relationship management;
  • Improvement and personalization of communications and product offers reserved for customers.

LGEMD DIGITAL processes this data in compliance with the GDPR (EU Regulation 2016/679), the French Data Protection Act (loi Informatique et Libertés), and the California Consumer Privacy Act (CCPA) for customers residing in California.

ARTICLE 14 – LIABILITY

LGEMD DIGITAL shall not be held liable for:

  • Any damage resulting from inappropriate or non-compliant use of the Products;
  • Any delivery delay attributable to carriers or customs authorities;
  • Any violation by the Customer of laws applicable in their country of residence;
  • Any false declaration by the Customer regarding their age or place of residence;
  • Any force majeure event within the meaning of Article 1218 of the French Civil Code.

ARTICLE 15 – INTELLECTUAL PROPERTY

All elements of the Site are the exclusive property of LGEMD DIGITAL. Any unauthorized reproduction or use is prohibited and constitutes an infringement punishable under French and international intellectual property law.

ARTICLE 16 – MEDIATION AND DISPUTE RESOLUTION

16.1 – Prior Complaint

In the event of a dispute, the Customer should first send a written complaint to support@beastylov.com. LGEMD DIGITAL commits to responding within 48 business hours.

16.2 – Consumer Mediation (EU/France)

In accordance with Articles L.611-1 et seq. of the French Consumer Code, if a dispute is not resolved amicably within 60 days, the Customer may refer the matter free of charge to:

The Customer has one year from the date of their written complaint to contact the mediator.

16.3 – European ODR Platform

For EU consumers: https://ec.europa.eu/consumers/odr

16.4 – US Customers

For customers residing in the United States, in the event of a dispute not resolved amicably, the parties agree to first seek resolution through mediation or arbitration in accordance with the laws of the Customer's state of residence, before pursuing any legal action.

16.5 – Jurisdiction

Failing amicable resolution, any dispute shall be submitted to the competent French courts, subject to mandatory consumer protection rules applicable in the Customer's country of residence.

ARTICLE 17 – GOVERNING LAW

These T&Cs are governed by French law. For consumers residing in the European Union, the mandatory consumer protection provisions of the Customer's country of residence remain applicable. For consumers residing in the United States, the mandatory consumer protection rights of their state of residence also remain applicable.

ARTICLE 18 – MISCELLANEOUS

These T&Cs constitute the entire agreement between LGEMD DIGITAL and the Customer. If any clause is declared null or unenforceable, the remaining clauses shall remain fully in force. LGEMD DIGITAL's failure to enforce any breach by the Customer shall not be construed as a waiver of the obligation in question.
