TERMS OF USE

ARTICLE 1 – PURPOSE AND SCOPE

These Terms of Use (hereinafter "ToU") define the terms and conditions of access to and use of the BeastyLov website (hereinafter "the Site"), operated by LGEMD DIGITAL, a French Simplified Single-Shareholder Company (SASU) with share capital of €100, registered with the La Rochelle Trade and Companies Register under number 825 409 733, with registered office at BP n°26, 2 Rue de la Brigantine, 17000 La Rochelle, France (hereinafter "the Publisher").

Access to and use of the Site are subject to these ToU. Any access to the Site implies full, unconditional acceptance of these ToU by the user (hereinafter "the User"). The Publisher reserves the right to modify these ToU at any time. Modifications take effect upon online publication. Users are responsible for regularly reviewing the current ToU.

ARTICLE 2 – ACCESS TO THE SITE

2.1 – Access Conditions

Access to the Site is exclusively reserved for adults. A person is considered an adult if they are at least:

18 years old in France, the European Union, the United Kingdom, and Australia;
21 years old in US states requiring a higher legal age;
The applicable legal age in any other country of residence.

By accessing the Site, the User declares under oath to have reached the legal age required in their country of residence and that accessing adult content is legal in their country of residence.

2.2 – Age Verification

An age verification system ("Age Gate") is in place at the entrance to the Site. The User must confirm their majority before accessing the Site's content. This declaration is the User's sole responsibility. LGEMD DIGITAL cannot be held liable for any false age declaration.

2.3 – Geographic Restriction

Access to the Site and ordering of Products are prohibited in countries where viewing adult content, or the purchase, importation, or possession of the Products offered is illegal. It is the User's responsibility to be aware of the laws applicable in their country of residence. LGEMD DIGITAL reserves the right to block access to the Site from any country where its operation would be unlawful.

2.4 – Site Availability

The Publisher strives to ensure Site availability 24/7 but cannot guarantee it. Access to the Site may be interrupted at any time for maintenance, technical updates, force majeure, or any other legitimate reason. The Publisher shall not be held liable for any interruption or unavailability of the Site.

2.5 – Required Equipment

Access to the Site requires an internet connection. Costs related to internet access and computer equipment are the User's sole responsibility.

ARTICLE 3 – USER ACCOUNT

3.1 – Account Creation

The User may create a personal account on the Site to facilitate purchases and track orders. Account creation is reserved for adults and requires the provision of accurate, complete, and up-to-date information.

3.2 – Login Credentials and Security

The User is solely responsible for keeping their login credentials (email address and password) confidential. Any use of the account with the User's credentials is presumed to have been carried out by the User. In the event of loss, theft, or fraudulent use of credentials, the User must immediately notify LGEMD DIGITAL at support@beastylov.com.

3.3 – Account Liability

The User is solely responsible for all actions performed from their account. LGEMD DIGITAL shall not be held liable for any damage resulting from the fraudulent use of the User's credentials by a third party.

3.4 – Account Suspension and Deletion

LGEMD DIGITAL reserves the right to suspend or delete any user account in the event of:

Provision of false or inaccurate information during account creation;
Doubt about the User's age;
Fraudulent, abusive, or ToU-violating behavior;
Non-compliance with the Site's terms of use;
Abusive chargebacks or attempted payment fraud.

The User may also request deletion of their account at any time by contacting support@beastylov.com.

ARTICLE 4 – USE OF THE SITE

4.1 – Lawful Use

The User agrees to use the Site lawfully and in accordance with these ToU. The User is strictly prohibited from:

Accessing the Site as a minor or where adult content is illegal in their country of residence;
Using the Site for commercial purposes not authorized by LGEMD DIGITAL;
Attempting to hack, compromise, or disrupt the Site or its servers;
Collecting or extracting data from the Site by any automated means (scraping, bots, etc.);
Publishing or transmitting any unlawful, defamatory, obscene, threatening, or third-party rights-infringing content;
Reproducing, copying, or exploiting any element of the Site without prior written authorization from LGEMD DIGITAL;
Circumventing or attempting to circumvent the age verification system;
Impersonating a third party or providing false personal information.

4.2 – Use of Site Information

The information and content published on the Site are provided for informational purposes only. They do not constitute medical, sexological, or legal advice. The User is solely responsible for the use they make of the information available on the Site.

4.3 – Hyperlinks

The Site may contain links to third-party websites. These links are provided for informational purposes only. LGEMD DIGITAL has no control over the content of these sites and accepts no liability for their content, availability, or data protection policies.

ARTICLE 5 – SITE CONTENT AND INTELLECTUAL PROPERTY

5.1 – Protected Content

All elements constituting the Site, including without limitation texts, images, photographs, graphics, logos, icons, sounds, videos, software, databases, structure, visual identity, and any other content (hereinafter "the Content"), are the exclusive property of LGEMD DIGITAL or are subject to a license granted to LGEMD DIGITAL.

5.2 – Prohibition on Reproduction

Any reproduction, representation, modification, publication, transmission, or distortion, in whole or in part, of the Site's Content, by any means and on any medium, is prohibited without the prior written authorization of LGEMD DIGITAL, under penalty of legal proceedings in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code and applicable international intellectual property law.

5.3 – Trademarks and Logos

The trademarks and logos appearing on the Site are registered trademarks. Any use, reproduction, or representation, in whole or in part, of these trademarks or logos, without the express prior authorization of LGEMD DIGITAL, is strictly prohibited and constitutes an infringement punishable under intellectual property law.

5.4 – Links to the Site

Any hyperlink pointing to the Site must be subject to prior written authorization from LGEMD DIGITAL. Deep linking and framing are strictly prohibited without authorization.

ARTICLE 6 – ADULT CONTENT AND WARNINGS

6.1 – Nature of Content

The Site contains images, descriptions, and information relating to adult and intimate products. This content is legal but exclusively reserved for adults. The User expressly accepts being exposed to this type of content by accessing the Site.

6.2 – Personal Use

The Site's content is intended for strictly personal and private use. The User agrees not to share, distribute, or make the Site's content accessible to minors.

6.3 – Parental Controls

ARTICLE 8 – PERSONAL DATA PROTECTION

8.1 – Data Controller

LGEMD DIGITAL, SASU, BP n°26, 2 Rue de la Brigantine, 17000 La Rochelle, France, is the data controller for personal data collected through the Site.

8.2 – Data Collected

In connection with the use of the Site, LGEMD DIGITAL may collect the following data:

Identification data (last name, first name, email address);
Contact data (postal address, phone number);
Transaction data (order history, payment method used);
Browsing data (IP address, cookies, pages visited);
Age declaration (as part of the age verification process).

8.3 – Purposes of Processing

The data collected is processed for the following purposes:

Order management and tracking;
Customer relationship and after-sales service management;
Verification of the User's legal age;

Sending commercial communications (with consent);
Compliance with legal and regulatory obligations.

8.4 – Legal Basis for Processing

The processing carried out by LGEMD DIGITAL is based on the following legal grounds:

Performance of a contract for order management;
User consent for commercial communications and certain cookies;
Legal obligation for the retention of accounting and tax data;
Legitimate interest for fraud prevention and Site security.

8.5 – Data Retention

Personal data is retained for the period strictly necessary for the purposes for which it was collected:

Order data: 10 years (legal accounting obligation);
Customer account data: duration of account activity + 3 years after the last order;
Browsing data and cookies: maximum 13 months;
Commercial prospecting data: 3 years from the last contact.

8.6 – Data Recipients

The User's personal data may be shared with the following sub-processors, strictly within the scope of their services:

Shopify International Limited (hosting and e-commerce platform);
Shopify Payments (payment processing);
Dropshipping suppliers (order fulfillment — transfers outside the EU governed by Standard Contractual Clauses);
Logistics providers and carriers (delivery).

These sub-processors are subject to strict confidentiality obligations and may only use data for the purposes for which it was transmitted. LGEMD DIGITAL does not under any circumstances sell its customers' personal data to third parties.

8.7 – International Data Transfers

Some sub-processors (including Shopify and dropshipping suppliers in China) may be located outside the European Union. These transfers are governed by appropriate safeguards, including Standard Contractual Clauses (SCCs) approved by the European Commission.

8.8 – Individual Rights

In accordance with the GDPR, the User has the following rights regarding their personal data:

Right of access: obtain confirmation that data concerning you is being processed and receive a copy;
Right to rectification: have inaccurate or incomplete data corrected;
Right to erasure: request deletion of your data (subject to legal retention obligations);
Right to restriction: request temporary suspension of the processing of your data;
Right to data portability: receive your data in a structured, machine-readable format;
Right to object: object to the processing of your data for commercial prospecting purposes;
Right to withdraw consent: withdraw your consent at any time for consent-based processing.

8.9 – Specific Rights for California Residents (CCPA)

In accordance with the California Consumer Privacy Act (CCPA), California residents have the following additional rights:

Right to know what personal data is collected;
Right to request deletion of personal data;
Right to opt out of the sale of personal data (LGEMD DIGITAL does not sell your data);
Right to non-discrimination for exercising these rights.

ARTICLE 9 – PUBLISHER LIABILITY

9.1 – Limitation of Liability

LGEMD DIGITAL shall not be held liable for:

Direct or indirect damages resulting from accessing or using the Site;
Site interruptions or unavailability;
The accuracy, completeness, or currency of information published on the Site;
The use made by the User of the Site's content;
Damages resulting from fraudulent third-party intrusion that led to modification of information published on the Site;
Any indirect damage, even if LGEMD DIGITAL was informed of the possibility of such damages.

9.2 – Force Majeure

LGEMD DIGITAL shall not be held liable for failure to fulfill its obligations in the event of a force majeure event within the meaning of Article 1218 of the French Civil Code.

ARTICLE 10 – SITE SECURITY

LGEMD DIGITAL implements appropriate technical and organizational measures to ensure the security of the Site and the protection of its Users' personal data, in accordance with GDPR requirements. However, no security system is infallible. LGEMD DIGITAL cannot guarantee the absolute security of data transmitted over the internet.

If a User discovers a security vulnerability on the Site, they are invited to immediately notify LGEMD DIGITAL at support@beastylov.com.

ARTICLE 11 – GOVERNING LAW AND DISPUTE RESOLUTION

11.1 – Governing Law

These ToU are governed by French law. For Users residing in the European Union, the mandatory consumer protection provisions of their country of residence remain applicable. For Users residing in the United States, the mandatory rights applicable in their state of residence also remain applicable.

11.2 – Prior Complaint

In the event of a dispute relating to the use of the Site, the User is invited to first contact LGEMD DIGITAL at support@beastylov.com. LGEMD DIGITAL commits to responding within 48 business hours.

11.3 – Mediation

If a dispute is not resolved amicably within 60 days, the consumer User may refer the matter free of charge to the consumer mediator:

11.4 – European ODR Platform

For EU consumers: https://ec.europa.eu/consumers/odr

11.5 – US Customers

For Users residing in the United States, in the event of a dispute not resolved amicably, the parties agree to first seek resolution through mediation or arbitration in accordance with the laws of the User's state of residence, before pursuing any legal action.

11.6 – Jurisdiction

Failing amicable resolution, any dispute shall be submitted to the competent French courts, subject to mandatory consumer protection rules applicable in the User's country of residence.

ARTICLE 12 – MISCELLANEOUS

12.1 – Entire Agreement

These ToU constitute the entire agreement between LGEMD DIGITAL and the User regarding the use of the Site.

12.2 – Severability

If any clause of these ToU is declared null or unenforceable by a competent court, the remaining clauses shall remain fully in force.

12.3 – Non-Waiver

LGEMD DIGITAL's failure to enforce any breach by the User of any obligation under these ToU shall not be construed as a waiver of the obligation in question.

12.4 – Language

In the event of translation of these ToU into another language, the French version shall prevail in case of contradiction.
